UK Introduces Transitional Arrangements for Senior or Specialist Worker Skill Level Requirements
Current rules
The Global Business Mobility – Senior or Specialist Worker route now includes a transitional arrangement for applicants who were granted permission under the rules in place before 4 April 2024. If their application date is before 4 April 2030 and they have had continuous permission as a Senior or Specialist Worker since then, they may be sponsored for a job in a SOC 2020 occupation code listed in Table 2b of Appendix Skilled Occupations. The general salary requirement for a Senior or Specialist Worker has been increased to £52,500 per year.
Overview
The UK Immigration Rules for the Global Business Mobility – Senior or Specialist Worker route have been amended to introduce new transitional arrangements. These arrangements permit applicants who were granted permission under the rules effective before 4 April 2024, and have maintained continuous permission, to be sponsored for specific occupation codes (listed in Table 2b of Appendix Skilled Occupations) until 3 April 2030. This change ensures a phased transition for certain workers previously eligible under different skill level criteria.
Who is affected by the latest change
- Existing Senior or Specialist Workers who received permission to stay under the rules that were in force before 4 April 2024
- Workers who have kept continuous Senior or Specialist Worker permission since that earlier grant
- Qualifying workers who move into one of the five specific Table 2b occupations
- UK employers who sponsor qualifying existing Senior or Specialist Workers
- Workers in the specific creative occupations who would otherwise not meet the current job eligibility rule
What changed in the latest version
Before
Before these changes, people applying for the Global Business Mobility – Senior or Specialist Worker visa route had to work for the sponsor group outside the UK for at least 12 months in total. This did not apply to people earning a high salary. Some people who received permission to stay before 4 April 2024 were sponsored for jobs in specific Standard Occupational Classification (SOC) 2020 occupation codes. Examples include Artists, Authors, Actors, Dancers, and Designers. These codes are listed in Table 2b of Appendix Skilled Occupations. The general salary that a Senior or Specialist Worker had to earn was £45,800 each year.
After
The Global Business Mobility – Senior or Specialist Worker visa route now includes a transitional arrangement. This is for people who received permission to stay under the rules that were in place before 4 April 2024. If their application is made before 4 April 2030, and they have had continuous permission to stay as a Senior or Specialist Worker since then, they can be sponsored for a job in a Standard Occupational Classification (SOC) 2020 occupation code listed in Table 2b of Appendix Skilled Occupations. The general salary that a Senior or Specialist Worker must earn has increased to £52,500 each year.
This update affects employers and individuals who use the Senior or Specialist Worker visa route a lot. The increased salary means companies must plan to spend more money on sponsored workers. This might affect how they hire people and how much it costs to move them. This new transitional arrangement helps some creative professionals who received permission to stay under older rules. It allows them to continue working under specific Standard Occupational Classification (SOC) codes for a limited time. However, there is a strict deadline for these specific jobs. Students who want to switch to this visa route now face stricter conditions. They must plan their studies and careers carefully.
Explained simply
Imagine you're in a special UK club for talented business people, like a creative artist or a writer, who came to work here from another country. If you joined this club before 4 April 2024 and have kept your membership valid ever since, there's a new temporary rule. This rule means you can keep doing your specific creative job in the UK until April 2030, even if the usual rules for new members might have changed. It's like having a 'grandfathered' pass that lets you continue under the old, more flexible rules for your particular type of work.
