U.S. Proposes Eliminating 60-Day Grace Period for Certain Nonimmigrant Workers Upon Cessation of Employment

The U.S. Department of Homeland Security (DHS) has issued a Notice of Proposed Rulemaking (NPRM). This proposal aims to remove the 60-day grace period that some nonimmigrant workers and their family members currently have. If this rule becomes law, it would bring back the old policy. This policy would make people in E-1, E-2, E-3, H-1B, H-1B1, L-1, O-1, or TN categories leave the United States straight away if their job or activity ends. They would only be able to stay if they have other permission. The proposal aims to re-establish a direct link. This link is between a person's nonimmigrant status and the specific job that gave them that status.
