UK Extends Scope of Right to Work Checks to Include Wider Working Arrangements and Introduces Extended Liability for Employers

The Border Security, Asylum and Immigration Act 2025 (BSAI 2025) has changed the Immigration, Asylum and Nationality Act 2006. It expands which 'employers' must check a person's right to work. It also widens the penalties for not following the rules. These changes mean legal duties now apply to more types of work arrangements, not just traditional employment. This includes individual sub-contractors and online matching services. The BSAI 2025 also brings in 'extended liability'. This means certain other organisations can be responsible for civil penalties if there is illegal working.
