U.S. Department of Homeland Security Corrects Permanent Residence Rules for Children Born to Foreign Government Employees

The U.S. Department of Homeland Security (DHS) has published a correcting change to an interim final rule (IFR). This rule is about registering for lawful permanent residence. It applies to children born in the United States whose parents work for a foreign government and are not U.S. citizens. This correction puts back specific evidence requirements that were removed from the rules by mistake. It also makes clear what children need to provide if their parents are foreign government employees but not diplomatic officers. This change became effective on 16 September 2026. It applies from 4 September 2026, which is when the original interim final rule started.
