Temporary Protection Directive for Ukraine Extended, with New Condition for New Applications
Current rules
The EU temporary protection regime for people displaced from Ukraine has been extended until 4 March 2028. The extension will take effect from 5 March 2027. In addition, from 5 August 2026, a new condition applies to new applications. People who are subject to military obligations under Ukrainian law must, in principle, demonstrate that they: have fulfilled their military obligations; or are legally exempt from those obligations. Evidence may include documentation issued by Ukrainian authorities. The precise evidence and procedure may vary according to the Member State implementing the rules. The new condition does not apply to people who already held temporary protection in the EU before the new rules took effect. It also does not apply to eligible people joining family members who already have temporary protection under the Directive.
Overview
The European Union has extended the Temporary Protection Directive (TPD) for Ukrainian displaced persons until 4 March 2028. Alongside this extension, a new condition takes effect from 5 August 2026, stipulating that new applicants with military obligations in Ukraine must now provide proof of having fulfilled these duties or possessing an exemption. This policy ensures continued protection for existing beneficiaries while introducing a specific requirement for future applicants.
Who is affected by the latest change
- Ukrainian nationals and other eligible people displaced from Ukraine who already hold temporary protection, because their protection will continue under the extended framework
- People applying for temporary protection for the first time from 5 August 2026, where they are subject to military obligations under Ukrainian law
- Applicants who must demonstrate compliance with Ukrainian military obligations or an applicable exemption
- Eligible family members joining people who already hold temporary protection, although the new military-obligation condition does not apply to them under the stated exception
- EU Member State immigration authorities, which must implement the extended framework and apply the new eligibility condition
- Employers, accommodation providers and public-service institutions dealing with beneficiaries whose temporary protection continues under the extended period
What changed in the latest version
Before
Temporary protection for people displaced from Ukraine was set to end on 4 March 2027. People who already had this protection could continue to live in the European Union country that hosted them. They could also use the rights that come with temporary protection. Before the new rule started, there was no specific requirement about military duties. This was not part of the common rules across the EU. The old system gave temporary protection to eligible displaced people. It did not have this extra rule about Ukrainian military duties.
After
The European Union's temporary protection for people displaced from Ukraine has been extended. It will now last until 4 March 2028. This extension will start on 5 March 2027. Also, a new condition will apply to new applications from 5 August 2026. People who have military duties under Ukrainian law must, generally, show one of two things: they have completed their military duties; or they are legally allowed not to do those duties. They can use official documents from Ukrainian authorities as proof. The exact proof and process may change depending on the European Union country applying these rules. The new condition does not apply to people who already had temporary protection in the EU before the new rules started. It also does not apply to eligible people joining family members. These family members must already have temporary protection under the Directive.
This policy change means that new applicants from Ukraine will face an extra requirement. This is especially true for those applying for temporary protection in the EU, including the Netherlands. They will need to show proof about their military service. People who must do military service now need to get proof from Ukrainian authorities. This proof must show they have completed their duties or are allowed not to do them. This might cause new administrative problems. It could also lead to delays or refusals for some people. However, people who already have temporary protection are not affected by this new rule. They will automatically get the extension of their protection until 2028. This ensures their rights and access to services will continue.
Explained simply
Imagine you're from Ukraine and need to find a safe place to live in Europe. Europe said you could stay until a certain date, but now they've said you can stay longer, until 4 March 2028! If you already have this protection, you don't need to do anything; it's sorted automatically. However, if you're a new person applying for this safe status after 5 August 2026, and you're a man who could be called up for military service in Ukraine, you now need to show papers that prove you've either done your military service or don't have to do it. It's like needing a specific permission slip to join the club if you're new, but if you're already in, you're fine.
